Adm issues the "provisions concerning Bingo modes, carried out with remote participation" with a directorial decree.

  With a directorial decree, published today, July, the 18th, the director of Adm, Giovanni Kessler, issued the "Provisions concerning Bingo modes, carried out with remote participation" for the determination of the general game conditions, the related technical rules and the unitary bet of participation in the game and every other aspect.   OPERATING AUTHORIZATION - According to what is written in the decree: "1. For the purposes of operating authorization of the remote bingo, even on the gaming circuit, the concessionaire submits an application to Adm, accompanied by the plan of gaming platform and the positive outcome of the certification aimed at ensure compliance of gaming platform and of the random number generator to the requirements reported in the latest version of the guidelines, approved by Adm. Subsequent changes of the essential characteristics of the platform project are subject to the prior approval of Adm and to a new certification, according to the ways and within the limits defined in the aforementioned guidelines. 2. Adm authorizes the subjects referred to in paragraph 1 following the positive outcome of the verification of compliance of the following elements: a) of the gaming platform project, with respect to the provisions of this provision; b) the methods of talk of the concessionaire's processing system with the centralized system, with respect to the communication protocol established by Adm itself with appropriate provisions".   DETERMINATION OF PRIZES - "1. For each virtual room, the concessionaire communicates to the centralized system, through the communication protocol, the values of the percentage rates of the prizes, to be assigned to the compulsory bingo prize, any optional prizes and funds for payment of jackpot prizes. The percentage to be allocated to the funds for the payment of jackpot prizes can never be higher than the one foreseen for the compulsory bingo prize. In the case of a gaming circuit, the same activities are carried out by the proposing concessionaire with reference to the whole circuit. 2. The concessionaire has the right to pay in advance an amount not exceeding € 100,000 for each virtual room to the jackpot funds. This amount is recovered by the concessionaire, after communication to the centralized system. 3. Concessionaires participating in a gaming circuit may pay in advance to the jackpot funds a total of no more than €250,000. This amount is recovered by the concessionaire, after communication to the centralized system. 4. The amount of the down payments to the jackpot funds referred to in paragraphs 2 and 3, made by each concessionaire and not yet recovered, may not exceed the amount of € 250.000. 5. For each virtual room and for the virtual rooms of a gaming circuit, the proposing concessionaire or the concessionaire communicates to the centralized system, through the communication protocol, the following data: a) the amounts of the optional prizes; b) the amounts of the jackpot prizes and the percentage rate to be applied to the amount of the jackpot fund. 6. The method of allocation and the percentages to be applied to the amount of the jackpot fund can be changed starting from the play after the one in which the prize is assigned, based on the values ​​previously applied".   UNIQUE TAX, PAYMENT AND COLLECTION - "1. The single tax referred to in the legislative decree of 23 December, 1998, No. 504 is applied to the remote bingo game and the payment for the centralized controller of the game, to the extent of 1 percent of the sale price of the cards, pursuant to Article 10, paragraph 9-septies, of the Decree-Law of 2 March 2012, No. 16, converted by law on 26 April, 2012, No. 44. The single tax is established, pursuant to paragraph 945 of the art.1 of the law 28 December 2015, n.208, to the extent of twenty percent of the sums that, according to gaming regulations, are not returned to the player. 2. The concessionaire makes the payment of the amounts due as per paragraph 1, according to the terms and conditions of article 4 of the Presidential decree 8 March 2002, n.66. 3. At least 70 percent of the collection on a statistical basis with reference to the solar month is allocated to the prize money, including any part for the jackpot fund. 4. It is not possible to allocate more than 30percent to the jackpot prize fund in the allocation of the prize money. 5. The concessionaire payment to cover the total costs for the running of the game, is the remaining portion of the collection net of the prize money, the single tax and the payment for the centralized gaming controller".   PRICES OF CARDS - "1. The price of the cards is chosen by the concessionaire for each game and can not exceed € 10. The price of the cards must be equal to one euro cent or its multiple. 2. For each type of prize, the price of the cards must be the same for all players. Within the same game, the sale of different price cards is allowed, if they compete in different prize money. 3. The sale of cards with share play is allowed. Share play are considered in full at the end of the prize money".   SHARE PLAY - "1. The amount of each share coupon is equal to the total value of the share play, divided by the total number of coupons which are part of it. The number of coupons can not exceed the limit of one hundred. 2. The share play must be made so it doesn't produce surpluses, ie the division into coupons should not produce surpluses and do not produce thousands of euro. 3. The amount of the winning made with the single share coupon is determined by the ratio between the sum of the amount of the prizes obtained with the entireshare play and the total number of the issued coupons. 4. The unsold share coupon are not considered winners".     PLAYER PROTECTION - "1. The concessionaire promotes responsible gaming behavior, control its adoption by the player, through tools and measures for self-limitation or self-exclusion from the game. He undertakes to ensure the exclusion from the game by minors, as well as the exposure of the related prohibition in a visible manner in the virtual gaming environments.The activation of self-limitation tools by the player is compulsory, otherwise it is impossible to enter in the gaming area.     DECLINE, SUSPENSION AND REVOCATION - "1. Without prejudice to the cases of revocation and decline provided for by the conventions for the awarding of public games, the authorization referred to in Article 2 shall be subject to the administrative leave, with due provision of Adm, until the date when the concessionaire fails to comply with the requirements communicated by Adm or, in the case of non-compliance for more than 30 days from the communication, until the administrative procedure is closed and the final decision on the adoption of the decline order is issued , in the following cases: a) in case of loss of the authorization requirements, referred to in article 2, b) when repeated violations of the provisions of articles 8, 9 and 10 are committed, running the activity. 2 The suspension takes effect from the date of the communication of the same to the concessionaire. No refund, indemnity or compensation is due to the concessionaire, even in the event that no provision for revocation of the authorization is adopted. 3. In case of revocation or decline of the bingo game authorization, or in case of failure to collect for a bingo game protracted for a year, the prizes not distributed to the players are donated to the Treasury. As an alternative, the transfer of prizes not distributed to the jackpot funds of other authorized bingo games is allowed".   THE APPLICATION OF THE DECREE - Finally: "1. The provisions of this provision shall apply as from the one hundred and twentieth day following its publication on the website of the Agenzia delle dogane e dei monopoli which, pursuant to Article 1, paragraph 361, of the law of 24 December 2007, No. 244, takes place of publication in the Official Gazette. 2. Authorizations to operate remote bingo already issued, pursuant to the directorial decree of 24 May 2011, are adequate, under penalty of decline, to the provisions of this provision within one hundred and eighty days from the application of the same, after which the provisions of the directorial decree of 24 May 2011, entitled 'Provisions about the way of bingo, made with remote participation', and subsequent amendments come to an end. 3. The provisions of this provision, including those referred to in Article 5, apply only to the appropriate authorizations pursuant to paragraph 2".
