Casino Campione, Supreme Court confirm the cancellation of bankruptcy

The Supreme Court confirmed the judgment of the Court of Appeal, which abolished the bankruptcy of the Casino di Campione d'Italia.

The Supreme Court ruled "inadmissible" the appeal presented by the Banca Popolare di Sondrio, where the establishment, creditor of the Casino Campione d'Italia, argued the case that the management company was "non-fallible" and, consequently, precisely because it was a cross-claim, has dropped the defense that had been presented by the curatorship. Consequently, the judgment of the Milan's Court of Appeal is confirmed, with which the judgment of the Court of Como (it was July, the 27th, 2018), which had declared bankrupt the company, due to insolvency, was abolished for a technicality. We are therefore moving towards a new process to establish the bankruptcy, or not, of the company. After the judgment of the Milan's Court of Appeal, once again seized the matter, the Como court had in fact decided to postpone all decisions to those that would have been taken by the Supreme Court regarding the two "cross" appeals. Decision that has finally arrived, after the hearing that was held on November, the 3rd.
